Brief overview about the research work:
The Constitution of India, at the time of its commencement, ensured various socio-economic, civil and political rights to its subjects. However, with the gradual change of the society the canvas relating to the various rights have been changed. Right to move freely throughout the territory of India is one of such rights which is protected under Article 19(1)(d) of the Constitution of India for all citizens. But emerging population, rise in the number of private vehicles and various other conflicting interests have rendered the said right futile. The present study relating to the Analysis of the Right of Citizens to Move Freely throughout the territory of India with special reference to the road traffic conditions in Siliguri Municipal Corporation tends to evaluate the conflicting interests involved around the impugned right. It has been observed in our pilot study that people of Siliguri is facing the problem of road traffic which significantly affects their fundamental freedom. Therefore, to quench the research query our researchers have sampled 60 inhabitants of Siliguri by using probabilistic non-systematised random sampling method and 10 law enforcement officers were selected by using non-probabilistic sampling method. The data was collected from the sampled respondents by using the tool of structured questionnaire including both open and close ended set of questions. To analyse the causality of different variables appropriate scaling techniques were used. The data so collected, both qualitative and quantitative, have been analysed, cross verified and presented in both tabular and pictorial form. Finally with the collected data researchers have tested the assumed hypothesis and appropriate suggestive measures were recommended.
